These Terms of Use ("Terms") govern your access to and use of H2O CERT, including h2ocert.com and our mobile app (together, the "Service"), operated by H2O CERT ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
H2O CERT is an independent study and practice-exam tool for water and wastewater operator certification. It is built around publicly available certification standards (such as those published by the Association of Boards of Certification) and, where noted, South Carolina's certification framework. H2O CERT is not affiliated with, endorsed by, or operated by SCDES, ABC, or any state certifying authority. Practice questions are original content created for study purposes and may not exactly match questions on any actual certification exam.
H2O CERT is a study aid, not a guarantee. Using the Service, including achieving high scores on practice quizzes or exams, does not guarantee that you will pass any official certification exam. You remain responsible for confirming the requirements of your certifying authority and studying any official materials it requires.
You need an account to use most of the Service. You're responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information when you register, and let us know if you believe your account has been accessed without authorization.
H2O CERT offers a free tier with limited daily practice questions, and a paid Premium tier with unlimited practice and full exam simulations. Premium is billed through Stripe on a recurring basis until you cancel. You can cancel anytime from the Upgrade page in the app; your access continues through the end of the period you already paid for.
From time to time we may offer promotional codes for free or discounted Premium access. Promo codes are limited to one redemption per customer, are valid only during the stated window, and may be modified or discontinued at any time. We reserve the right to revoke access granted through a promo code we determine was obtained fraudulently or in violation of these Terms.
Fees are generally non-refundable except where required by law or as we decide to grant on a case-by-case basis — contact us if you believe you were charged in error.

The question bank, explanations, and other original content in the Service are owned by H2O CERT and provided for your personal, non-commercial study use. If you submit feedback, flag a question, or report a bug, you grant us the right to use that submission to improve the Service, without any obligation to compensate you for it.
The Service is provided "as is" and "as available." While we work to keep the question bank accurate and up to date, we don't guarantee that all content is error-free, complete, or current with the latest version of any certifying authority's exam criteria. We disclaim all warranties, express or implied, to the fullest extent the law allows.
To the fullest extent permitted by law, H2O CERT and its operator won't be liable for indirect, incidental, or consequential damages arising from your use of the Service, including any exam outcome. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
You can stop using the Service and delete your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with notice where practical.
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles.
